Coats & Bennett is proud to announce that Attorneys William G. Pagán and Edward H. Green III both had unblemished records on Appeal before the Patent Trials and Appeal Board (PTAB) in 2019, obtaining complete reversals of the Examiner’s rejections in six out of six cases.  Not a single rejection was affirmed by the PTAB in any of their cases decided in 2019.

The winning cases include Appeal Nos. 2018-007678, 2018-006623, 2018-008489, 2018-006883, 2018-008544, and 2018-007939.  Collectively, the Appeals challenged patent claim rejections under 35 U.S.C. § 103 (obviousness) and 35 U.S.C. § 112 (written description).  The positive results obtained in these cases reflect the high degree of patent prosecution skill and experience these two attorney-engineers bring to the table.

Upon learning of his 2019 performance on Appeal, Attorney Pagán (responsible for four of the six appeals) remarked:

The Appeal process can be both scary and costly for many Applicants.  However, we hope that our track record on Appeal gives Applicants the confidence to press their case forward when merited.  Indeed, a timely Appeal Brief can often save clients time and money by increasing the scrutiny on rejections that are not well-founded, and motivating the Patent Office to resolve prosecution more compactly.
